Procedure for Disciplinary Action and Appeals Process
Outlined below are steps and procedures for administering cases of misconduct towards match officials and general appeals to NCASA.
Disciplinary Procedure – Misconduct towards Game Officials
A. Match reports (including any player cards) relating to referee assaults must be sent to NCASA office as soon as possible after incident occurs … no more than 72 hours if possible.
B. NCASA office sends out acknowledgement letter to the referee, player(s) involved, State Referee Administrator, League President (Administrator), Team Manager or Representative and the members of the Appeals and Consultation Board (including contact information on the referee, involved player and team manager).
C. Chair of the Board of Appeals and Consultation (BAC) conducts or designates an uninvolved third party to conduct background investigation into the incident and prepare a report of findings.
D. The letter from NCASA to the referee and other involved individual(s) should include a request that they submit a written statement relating to the incident. The letter should also outline the automatic penalties for referee abuse or assault.
E. After receipt of letters from referee and other involved individuals, a hearing will be scheduled.
F. After the hearing, the BAC will make a timely decision and enable the NCASA office to communicate the outcome back to all central parties.
G. Penalties for Misconduct toward Game Officials will be in accordance with NCASA and USSF policy guidelines.
NCASA Appeals Process
The purpose of the North Carolina Amateur Soccer Association appeal procedure is to provide a fair consideration of matters in dispute within the family of NCASA and its member organizations. Nothing in the procedure shall take precedence over the Rules of NCASA, USASA and of USSF.
Manner of Appeal: 1. The Executive Vice-President of the Association chairs the NCASA Board of Appeals and Consultation (BAC). The BAC has the responsibility to hear appeals forwarded to the Association from decisions by affiliated bodies. It shall also serve to recommend courses of action to the Executive Committee in areas of controversy and to adjudicate these matters wherein jurisdiction rests with the Association.
2. The BAC will conduct hearings concerning any alleged assault on a referee in accordance with applicable USSF rules. The BAC will provide equitable and prompt hearing and appeal procedures to guarantee the rights of individuals to participate and compete. Those procedures shall include that all grievances involving the right to participate and compete in activities sponsored by the Federation and the State Association and its members may be appealed to the Federation’s Appeals Committee that shall have jurisdiction to approve, modify or reverse a decision.
3. The BAC should be comprised of individuals who do not actively participate in the direct affairs of any of the concerned affiliated organizations. There shall be at least three members present to hear any appeal or transact any other matter to come before the Board. Any Board member who is an interested party in any case shall be excused from the proceedings of that particular case.
4. Any person discussing a case with a board member with the intention of influencing the decision other than in the course of the investigation of the matter shall be subject to official censure, and the board member may disqualify himself from the case.
5. The appealing group shall submit all appeals in writing to the Chairman of the Board of Appeals and Consultation at the NCASA state office within 30 days after notification of the decision. The appeal shall be accompanied by a check of $25.00 - which shall be the appeal fee. In the event the Board upholds the appeal, the appeal fee shall be returned to the appellant.
